USER'S APP TERMS AND CONDITIONS

GO CHARIOTS LEGAL

READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING OUR SERVICES.

GOCHARIOTS TERM OF SERVICE:

These Terms and conditions of Service constitute a legally agreement (the “Agreement” and/or “Term of Services”) between you (“User” and/or “Third-Party Drivers” (“TPD”)) and GoChariots LLC., its representatives, affiliates, agents, labor force, officers, directors, employees, owners and co-owners (collectively, “GoChariots”, “Chariots”, “we”, “us” or “our”) governing your use of the GoChariots Digital Application (App), Website, Services, Technology, Vehicles and Facilities (collectively, the “GoChariots platform”).

PLEASE BE ADVISED:

You agree GoChariots LLC is free of any responsibilities of any matter while you are using our services through our App (software, web-app, vehicles, or any other GoChariots platform related services).

GoChariots do not warranty the quality, safety or the ability of Third-Party Drivers who provide service through our Platform.

TERMINOLOGY:

This applies to any user of GoChariots services anywhere, including users of the digital platform, website and other future services.

1- User

Person who requests ride-hailing services through our digital app.

2- TPD (Third Party Drivers)

Person who provides ride-hailing services to the users through our digital app.

You agree: 

(1) Waive your right of jury trial and (2) Waive the right submit any claim, legal dispute and controversies of any matter against GoChariots LLC on an individual basis, multiple individuals, mass, collectively, or consolidated in representing of any group of any kind. (3) Waive the right to jury trial against GoChariots, in case of any kind of accident or incident caused by a third-party event, even if this is related with or while you are using the GoChariots services through our platform. (4) You agree in accepting the entire risk that may occur by using our services requested by yourself through our platform. (5) Your continued access and/or use of this platform after such posting constitutes your consent or acceptance to be bound by the terms and conditions or terms of services, as amended. (6) All Disputes and claims between us (each “claim” or “collectively claims”) shall be exclusively resolved by binding arbitration solely between you (“user” or “driver”) and in some cases with GoChariots (refunds or complains). (7) You waive your right of jury trial; submit any claim, legal dispute or controversy against GoChariots in case of a TPD misbehavior. GoChariots select and approves third-party independent contractors with clean criminal record, but we do not guarantee the personal behavior of each of them. Any legal dispute, claim, or controversies you have, must be resolved solely between you, the third-party driver and the right law authorities on your location.

GOCHARIOTS SERVICES.

Our services denominated as a GoChariots Services Platform to provide solutions by whom requested (“Users”).

This platform offers you the option to request or receive convenient ride-hailing service on demand; pairing your device with Third-Party Driver (TPD), who are near by the location that you provided on our platform into your user account automated setup. 

Once you request a ride-hailing service, we notify to the TPD about your ride request; It is on a total Third-Party Driver discretion to accept or decline customer support to your request. It is also your discretion to decide whether to accept such services from a Third-Party Driver.

Once the ride started you may not be allowed to cancel it or reschedule your service requested. In case of GoChariots be able to cancel or reschedule your request, it may be charging a fee and/or it could be an extra charge for the services prior requested.

Third-Party Drivers Services (TPD Services)

TPD offer ride-hailing service using their personal vehicles through GoChariots App, their vehicles meet and exceed the requirements requested by law and they are capable to offer this kind of services. You must know that you are on your own risk when you are using the services and that GoChariots is not responsible or liable for any service of such TPD.

In the event of a conflict in the terms of any TPD Services and these Terms, these Terms shall control with respect to GoChariots and your agreements with GoChariots herein, and the limitations of liability.

GOCHARIOTS DOES NOT PROVIDE TRANSPORTATION OF ANY KIND, PERSONAL OR COMMERCIAL, LOGISTIC SERVICES, CARRIERS OR SIMILAR. ALL THE SERVICES PRIOR MENTIONED ARE PROVIDED FOR THIRD-PARTY DRIVERS (TPD) WHO ARE NOT EMPLOYED BY GOCHARIOTS LLC. THE RELATIONSHIP BETWEEN THE THIRD- PARTY DRIVERS (TPD) WITH US DO NOT ALLOW THEM TO REPRESENT THEMSELVE AS GOCHARIOTS AUHORIZED REPRESENTATIVE, ASSOCIATE, EMPLOYEES OR AGENTS OF ANY KIND OR ANY WAY. 

When you as a “User” authorize GoChariots to pair you with “Drivers” under the fact of your pickup location, destination info, user stats, user preferences, methods of payment and cancelation of any other service, it is a sole decision made from such the User. GoChariots does not have any responsibility on the “Users” priorities or request while using our platform and web app services.

By entering and reading into this agreement, accessing, make use of the GoChariots LLC Platform, you automatically are accepting you acknowledge you understand this agreement and accept all the terms and conditions with no hesitate.

If you are not agreeing with the term and conditions of this platform, software or service provider; you may have not access to use any of our actual or future services related with GoChariots Platform.

OUR LICENSE.

Subject to your compliance with these terms and conditions, GoChariots grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferrable license to access and use our platform on your personal device solely only. These digital services are forbidden to use it for commercial purposes. Any rights not expressly granted herein are reserved by GoChariots.

All intellectual property rights, services, name brands, and all interests related with GoChariots platform are and shall be owned by GoChariots entirety and absolutely.

These Terms of Service do not grand you any right on any service or right to ownership on GoChariots’s services and/or intellectual property, do not consider this terms and conditions as an intent of sale, trade or lease, except for the limited license granted to you herein. 

Modification and Termination to the Agreement

GoChariots may immediately terminate or modify these terms and conditions or any services that we provide with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

GoChariots may amend the terms and conditions related to the services we provide every time we considered necessary. All the amendments will be effective when GoChariots update terms and conditions at this location or the amended policies and supplemental terms. 

Eligibility to use our Platform.

GoChariots platform may be used by who have the authority to comply with this agreement and it terms, conditions and obligations. 

The GoChariots Platform may not be available to users whom are inactive log in for long period of time or for users who have had their user account temporarily or permanently deactivated.

It is forbidden others or third parties to use your personal “User” or “Driver” accounts. You agree that you are the only one authorized user (“User” or “Driver”) of your own account and don’t let third party use GoChariots Platform.

GoChariots have the right to cancel or deactivate any additional or duplicate accounts and the termination of your access to use our services. 

If you want to become a GoChariots user, you shall be minimum 18 years old. 

GoChariots reserves the right to refuse service to minors who are not accompanied by an adult.

You as a User ensure that any minor does not request or accept any of our Services unless accompanied by you or an authorized guardian. 

RESTRICTIONS.

YOU SHALL NOT: 

(1)  Use, copy or remove any GoChariots’s copyrights, trade dress, trademark, services logos and marks, or any other notices propriety belong to GoChariots without express, written permission from GoChariots.

(2)  Reproduce, modify, prepare any of the GoChariots derivatives of any kind, It is forbidden to lease, reproduce, lend, redistribute, transmit, stream, transmit, publicly perform GoChariots platform and services or any portion of it without GoChariots permits. 

(3)  Decompile, interfere, modify, use reverse engineer or disassemble the Services, Platform or/and Web App except as may be permitted by applicable law.

(4)  Stalk, threaten, or otherwise harass any person inside the vehicles, or carry any weapons.

(5)  Use or post of information of any of the GoChariots platform services, third party driver’s services, ride-hailing services in fraudulent, obscene, sexually oriented, profane, harassing, or any illegal ways. 

(6) Deliberate use of any software, spiders, warms, scripts, robots to generate impressions or clicks, pinch, hack, decipher, decompile, burning, modified, scraping, surveying, translate, indexing or alter in one way or another the functionality of any aspect of our Services, Data, Networks, Platform and any property that belong to GoChariots.

(7) Use of false email address or other identifying information like websites, promotions, demos, promo codes, gift cards, trade or sale of merchandise with GoChariot’s logos, impersonate and misrepresent of any entity accessing the GoChariots Platform and Services.

(8) Discriminate against “Users” and “Driver” based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under applicable law. Such discrimination includes, but is not limited to, any user refusing to provide or accept services based on any of these characteristics. Any user found to have violated this prohibition will lose access to GoChariots services. Applicable laws in certain jurisdictions may require and/or allow the provision of services by and for the benefit of a specific category of persons. In such jurisdictions, services provided in compliance with these laws and the relevant applicable terms are permissible under this policy.

(9) Authorize third parties to use your user or driver account.

(10) Authorize persons under the age of 18 to use GoChariots Platform at any time. 

(11) Lease, sub-lease or try to make a side business or no joint venture with the GoChariots Platform in benefit to third parties none related with this terms and conditions. 

(12) Use the GoChariots Platform for commercial purposes. 

DISCLAIMERS, LIMITATION OF LIABILITY AND INDEMNITY.

Disclaimers

The following disclaimers are made on behalf of GoChariots, affiliates, subsidiaries, parents, successors, agents and assigns, and each of our respective officers, directors, employees, owners and co-owners.

The GoChariots Platform is provided on an “as is”basis and without any warranty or condition, express, implied or statutory.

GoChariots makes no representation, warranty or guarantee about the reliability, timeliness, complete, reliable, current, deletion, failure to storage, secure, uninterrupted, error-free, available, quality, suitability or always available of services, or will meet your requirements, that any defects in the GoChariots Platform will be corrected, or that the GoChariots Platform is free of viruses or other harmful components or any service or goods requested through the use of our Platform.

We disclaim liability for, and no warranty is made with respect to, connectivity, availability, accuracy, completeness, and reliability of the GoChariots Platform or Services, Third-Party Drivers’s Services, Ride-request Services, including with respect to maps, navigation, estimated fares, ETAs, and routing services. You are always responsible for your conduct and the consequences of your conduct while using our services.

GoChariots recommend you use the GoChariots Platform with a data plan with unlimited or very high data usage limits. GoChariots shall not be responsible or liable for any fees, costs, or overage charges associated with any data plan you use when you access the GoChariots Platform.

Limitation of Liability

GoChariots shall not be responsible for indirect or incidental punitive or consequential damage, lost profit, lost data, property damage or injury, incidents or accidents related with this platform or while “Users” and “Drivers” are using it. GoChariots Shall not be liable for any damage, liability or losses related with: (1) Sharing information, data, relationship or transaction between you and TPIC (2) your ability to access and use this service provided by this platform (3) you acknowledge Third-Party Drivers (“TPD”) provide ride-hailing services and they may not be professionals or licensed permitted. GoChariots will not be responsible for any reason for accidents, incidents, TPDs misbehavior and/or for any emotional or physically damage, and losses of any kind while you (user or drivers) are using our platform.

GOCHARIOTS DOES NOT PROVIDE TRANSPORTATION OF ANY KIND, PERSONAL OR COMMERCIAL, LOGISTIC SERVICES, CARRIERS OR SIMILAR. ALL THE SERVICES PRIOR MENTIONED ARE PROVIDED FOR THIRD-PARTY DRIVERS (TPD) WHO ARE NOT EMPLOYED BY GOCHARIOTS LLC. THE RELATIONSHIP BETWEEN THE THIRD- PARTY DRIVERS (TPD) WITH US DO NOT ALLOW THEM TO REPRESENT THEMSELVE AS GOCHARIOTS AUHORIZED REPRESENTATIVE, ASSOCIATE, EMPLOYEES OR AGENTS OF ANY KIND OR ANY WAY.

Indemnity

You agree to indemnify GoChariots affiliates, subsidiaries, parents, successors, agents assigns and each of our respective officers, directors, employees, owners and co-owners.

You agree to be responsible in paying the arbitration and administrative cost (attorneys’ fee) if you file a claim in court. 

You agree GoChariots affiliates, subsidiaries, parents, successors, agents assigns and each of our respective officers, directors, employees, owner and co-owners are harmless from all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) if you:

(1) Violate any of this terms and conditions

(2) Your violation of the rights of any Third-Party Drivers.

BY AGREEING TO ARBITRATION, YOU UNDERSTAND THAT YOU ARE WAIVING THE RIGHT TO SUE GOCHARIOTS IN COURT OR HAVE A JURY TRIAL FOR ALL CLAIMS, EXCEPT AS EXPRESSLY OTHERWISE PROVIDED IN THIS ARBITRATION AGREEMENT.

Vehicle Requirements for TPDs

· 4 doors vehicle not older than 10 to 12 years (Depending on the category your vehicle is assigned)

· Personal Auto Policy Insurance (full coverage). 

· Good drivable condition and non-cosmetic damage

· No Commercial Branding. 

Background Check Information for TPDs:

GoChariots will search for driver’s criminal record (where permitted by the authorities), driving history, license status and prior addresses. This background check is submitted during the driver’s application process.

INFORMATION GOCHARIOTS COLLECT AND PRIVACY.

Our Compromise with you:

GoChariots will retain your Personal Data and Info for as long as is necessary for the purposes setup in this Terms and Conditions Policy only. When you agreed and access to GoChariots Platform, you provide us through your device your private information; and it is not-shared and non-transferred from GoChariots to other third-parties as: private or public entities, state or federal law enforcements unless in response to a legal obligation comply with a regulation, civil or criminal inquiry, investigation or legal process, resolve disputes and enforce this legal agreement related with GoChariots Terms and Conditions purposes.

Usage Data is generally retained for a short period of time, except when this Usage Data is needed to reinforce the security and to improve the functionality of GoChariots Services.

Remember that your Data may be deleted upon your request to info@gochariots.comand we will respond to your request within 60 days after you apply. 

Account Registration

You share with us information such as your name, e-mail address, DOB, profile photo, phone number and paying information. You will also have the option to share your preferred or saved addresses when you customize your profile; GoChariots will request you upload a document related with your identification, or maybe a selfie picture.

TPDs Information

If you submit your request to drive for GoChariots, we will collect the information you upload on your application such a: name, physical address, DOB, Driver’s license picture, “Selfie” every time GoChariots thinks it is necessary, social security number, vehicle model and personal auto insurance policy information and bank account to provide the payment from us to you.

Communications 

When you contact GoChariots or GoChariots contact you, including through surveys or research projects, we collect any information that you provide, including the contents of the messages or attachments you send to us.

Locations

The GoChariots Platform collects location information like GPS and WiFi data, IP address, and Bluetooth data, differently depending on your GoChariots app settings and device permissions.

This feature applies for both Users and Drivers as well while the platform is in use.

Communication between Drivers and Users

GoChariots works with third-party phone calls and text to keep Users and Drivers personal information safe and private.

COOKIES, ANALYTICS AND THIRD-PARTY RELATED TECHNOLOGIES. 

You have the right to choose whether to accept cookies. However, they are an important part of how our platform works. GoChariots using “Cookies”, Google Data Analytics (GDA), Beacons Technology and other third-party technologies collect information as: Device type, Operating System, Browser type and version, Website visited, Time of visit, IP Address, advertising identifiers, referring website, IP address and other information to make the functionality of our services and platform better.

CHARGES, REFUNDS, FEE, PAYMENTS AND TIPS.

Charges:

You understand and accept that use of GoChariots Platform and Services may result in “Charges”, “Payments”, “Fee” or “Withdraws” to you.

Finally, when you receive the service requested by you to a Third-Party Drivers through the GoChariots Platform, GoChariots will charge you for those services through legal third-party electronic service; including the applicable taxes where required by law. Charges paid by you are final and non-refundable. 

All Charges are due immediately and payment will be facilitated by GoChariots using your preferred payment method setup in your account setup.

Refunds:

Charges paid by you are final and non-refundable, unless GoChariots and Third-Party Drivers’s discretion. If you have any requests for cancellations, refunds, or returns please send us an email located in this location info@gochariots.comor in the tab located in your user account.

Please initiate your refund requests within 10 days after the Charge took place or GoChariots will have no further responsibility and you waive your right to later dispute the amounts charged.

GoChariots reserves the right to establish, remove and/or revise Charges for any or all services obtained using the Services and Platform at any time in GoChariots sole discretion. 

Cancelation Fee:

You may cancel a trip on the GoChariots platform before and after you’re matched with a driver without a charge, payment or withdraw reflected on your bank account, please be advised that (1) You as a User have three minutes to cancel the trip without any fee. (2) You can cancel a trip without fee even if the driver accepts the trip, but you notice the information provided on GoChariots Platform does not match (different vehicle showed up or if there is another person behind the wheels) and you also immediately report the problem to GoChariots. (3) If your GoChariots driver arrives and you don't show up within five minutes, they can cancel the trip themselves, leaving you with an automatic fee (20% of the price of the trip); In some cases, your cancellation fee will be based on how far the driver has already driven to pick you up or sometimes the full fare will be applied (4) The Drivers will be allowed to cancel the trip under their discretion; depending on the distance they are from User and also the restricted areas where the Users are located or the restricted address the Users what to go to (with no fee reflected on the User’s bank account). 

Vehicle’s Damage Fee:

In case one of the third-party drivers report us a property or a material damage to their vehicle from a user or their companions, you agree to pay up to $350 on the extent of the damage (as determined by GoChariots in its sole discretion). 

Vehicle’s Cleaning Fee:

In case one of the third-party drivers report us that his vehicle needs an extended cleaning because you, your companions or your pet dirty inside it, you agree to pay up to $200 on the extent of the clean (as determined by GoChariots in its sole discretion). 

Abuse Fee:

You agree and accept that GoChariots have the right to check (but this is not obligated) if all the documentation and information provided by users and drivers is real, the misuse and abuse of this Platform from you will be fined with a $300 fee.

Tips

You understand and accept that, you are free to give or not an additional payment as a tip to any Third-Party Drivers who provides you with GoChariots Services. You are under no obligation to do so, and if you so, please do it through the GoChariots Platform; please, never does it in cash form.

Toll Roads:

Usually, our rates are not calculated with a toll roads cost but in some cases if you require the third-party independent contractor take a toll road, an extra charge will be reflected in your account.

Other Charges:

Another fee and surcharges may be reflected on your ride included but not limited to taxes (where the law apply), airport fee, estate fee, local fee, event fee, waiting time fee, and distance surcharges determined by GoChariots or its marketing partners. 

Credit, Debit and Prepaid Card Payment Authorization:

Ride-hailing services, Third-Party Services (GoChariots Services) By accepting this agreement between you and GoChariots, you may be asked for your authorization of your personal financial information like bank account and/or your credit, prepaid or debit card to make the right payment for the services offered and be sure the charges will be covered. The Authorization is not reflected as a charge in your bank account, but it may reduce your available balance by the authorization amount until your bank’s next processing cycle. You may be subject to overdraft of NSF charges by the bank issuing your debit or prepaid card in case you do not have enough credits on your account. GoChariots is not liable for these charges, and we will not be able to assist you in recovering them from your issuing bank.

Payment to TPDs 

You acknowledge and agree that GoChariots is charging you a very low percent on realty of the total income caught from users who request our services through our platform; GoChariots knows it is not fair to deal with the daily traffic, vehicle's depreciation, food expenses, groceries, gas prices, tax payments and comeback home with the empty hands due the greedy way other companies handle their driver’s payoff. For a better convenience all the withdrawal could be made as many times as the TPD needs. (Charges may applies per transaction).

OTHER DISCLAIMERS

GoChariots and the third-party drivers reserves the right to refuse service to those people it considers highly dangerous and/or considers having a suspicious behavior, high levels of alcohol or in cause of any disturbance.

Minors

GoChariots reserves the right to refuse service to minors who are not accompanied by an adult.

We abide by the child protection policy against child abuse or abandon. 

Any suspicion of child abuse will be reported to the authorities. Our Services are generally not available for use by persons under the age of 18.

Neither GoChariots nor the third-party Drivers provides child restraint system and, neither GoChariots nor the TPIC are responsible for the safety of a child restraint system. Users must provide their own child restraint system and it is your obligation to ensure that the child restraint system is installed correctly, and that the child is properly secured in the child restraint system. 

Pets

Subject to the discretion of a TPD, you may or may not be allowed to take a small pet (service dog or cat) with you while you ride and enjoy GoChariots Services, you are obligated to secure your pet with a leash, harness or into a crate box or cage. You are responsible for that your pet does not cause any damage or a mess into the TPD’s vehicle, in case of any damage or littering you will charge for the repair or cleaning of the vehicle. 

COVID-19 Policy

Wearing a mask is still important to us but it optional for fully vaccinated passengers and drivers. Even if our vehicles are cleaned between every passenger, the third-party drivers reserve the right to refuse service to customers who do not wear a mask and are suspected of any symptoms of COVID-19.

Zero Tolerance Policy

Every TPD has a responsibility to drive safely and follow the established rules of the road. 

GoChariots has a zero-tolerance policy for the use of alcohol or drugs by third-party drivers while they are on duties.

If we receive reports of suspected impaired driving, the TPD will lose the right to access to GoChariots Platform, as stated in their agreement with GoChariots.

Firearms Prohibition Policy

Our goal is to ensure that everyone has a safe and enjoyable ride. That's why GoChariots prohibits TPDs from carrying firearms of any kind while working.

Anyone who violates this policy may lose access to our services and platform.

Discrimination Policy

GoChariots striving to provide safe, reliable, and high-quality service to everyone. GoChariots prohibit discrimination against users based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under applicable law. Such discrimination includes, but is not limited to, any user refusing to provide or accept services based on any of these characteristics. Any User or TPD found to have violated this prohibition will lose access to GoChariots services and platform. Applicable laws in certain jurisdictions may require and/or allow the provision of services by and for the benefit of a specific category of persons. In such jurisdictions, services provided in compliance with these laws and the relevant applicable terms are permissible under this policy.

Human Trafficking Policy

Combatting human trafficking will require sustained commitments from many sectors that is why all GoChariots TPD can help human trafficking victims who are traveling alone or to report suspicion of abuse to the authorities.
